Information Needed:

The information needed for us to prepare your case consists of a summary of your assets and debts, your personal statistical information (ie. date of marriage and separation, birth dates, etc), the basic terms of your dissolution agreement, such as who will receive certain assets, who will be responsible for certain debts, as well as custody and support arrangements. You may find that previewing our questionnaire is helpful in defining the terms of your settlement agreement. You may also want to gather certain records such as statements identifying creditors, insurance policies, retirement plans, account numbers, and the like prior to actually completing the questionnaire. Fees and How They Can Be Paid:

Our service begins with the necessary fees are paid and you acknowledge the terms of the fee agreement, which is available for your review by clicking on the fee agreement tab. Please note that all fees, terms, and conditions of our services are strictly limited to those set forth in the fee agreement. Please note that when we receive payment and consent to the terms of the fee agreement, we will promptly acknowledge our contractual obligation to you. If for any reason we cannot accept your case, such as in the event of a conflict of interest, we will notify you promptly and immediately refund any fee advanced.

Payment for our services can be made using Visa, Mastercard, American Express, and cash payments via PayPal.Com. Filing fees for the court must be paid directly to the court where your case is filed. We will provide instructions to you on how to pay the court when your documents are prepared.

Other Costs:

The filing fees that courts may charge in addition to our fee vary by county and generally range between $185 to $200 to file the petition. If you think you may qualify, we will prepare the necessary application for a court filing fee waiver as part of our services. Generally, if your spouse agrees with the terms of your proposed dissolution, no response need be filed in the court. Therefore, only one filing fee is required, unless waived. Should your spouse decide to file a response, the fee for the response is generally a few dollars less than the original filing fee for the petition. Court fees may be waived by the court for low-income persons.

Obligation of Spouse to Pay:

THE COURT HAS DISCRETION TO REQUIRE YOUR SPOUSE TO PAY YOUR LEGAL FEES AND COSTS IN CONNECTION WITH YOUR MARITAL DISSOLUTION BASED UPON YOUR SPOUSE’S ABILITY TO PAY. (CA Family Code §§ 270-271; 2030; 2032)
